WBFF PIGSKIN PICK’EM – Local Rules
General
UPICKEM is an online game being sponsored and promoted by The Douglas Group, Inc. dba UPICKEM (hereafter, “UPICKEM”) and a number of television stations located in different cities (please review UPICKEM’s official rules). In addition to the national game conducted by UPICKEM, television broadcast station WBFF will have a single weekly winner from all participants in the Baltimore, Maryland DMA.
Who Can Enter
1. To be eligible to participate in this contest, entrants must be U.S. residents, who are 18 years of age or older, and reside in the Baltimore, Maryland viewing area (the DMA).
2. Employees of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Sinclair Communications, LLC, and any other company which owns, programs or provides other services to television broadcast stations WBFF (the “Station”), WNUV, The Douglas Group, Inc., their affiliated companies, advertising and promotion agencies, any and all local television broadcast and cable stations, local radio and other media companies, and the immediate family members of each are ineligible. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren.
How to Enter / How to Win
(a) No purchase is necessary to enter. Only one entry accepted per person. An entrant who is otherwise a winner may be disqualified if they are found to have entered the contest more than once under separate e-mail accounts.
(b) The contest starts on September 14, 2009 at 12:00 p.m. ET, and ends at 12:00 p.m. ET on January 1, 2010 (the “Contest Period”).
(c) To enter, log onto www.foxbaltimore.com and click on the “Pigskin Predictions” icon. Register for this contest by entering your name, address, phone number, and birth date, together with responses to any informational questions included in the registration process. Registered entrants will need to log on to predict the winner of each regular season National Football League game, as well as determine the total points scored in game chosen by UPICKEM. Predictions may be made beginning anytime during the Contest Period, up until fifteen (15) minutes prior to the start time of the game. No mechanically completed entries will be accepted.
(d) Following the final game played each week during the Contest Period, entrants will receive a pre-determined number of points for each correct prediction. All entrants will be treated as having correctly predicted the winner of games ending in a tie. Points will be awarded weekly for the weekly prize, and points will accumulate over the Contest Period for the grand prize as further described below. In the event an entrant does not participate one week does not mean he can’t participate the following week. Participants can choose to play as much or as little as they see fit. The fewer weeks you play, the less points you will accumulate to count toward the final grand prize.
(e) Each week in which National Football League games are played during the Contest Period, the entrant with the highest number of points that week will receive a prize, for a total of sixteen (16) weekly winners. In the event of a tie, the entrant who comes closest in predicting the noted score of the designated game without going over will be deemed the winner. In the event that the tied entrants have the same answer to the tie breaker or the tied entrants all went over the noted score of the designated game, one winner will be randomly selected from among the tied entrants. No entrant may win a weekly contest as a result of points received by being automatically credited with points from the following week.
(f) At the end of the Contest Period, the entrant with the most points accumulated for the entire Contest Period will win the grand prize. In the event of a tie, one winner will be randomly selected from among the tied entrants.
(g) The Company is not responsible for lost, late, misdirected entries (including predictions), printing errors, software failure, server unavailability, computer or any other electronic malfunction. All entries received that are tampered with, illegible, or from ineligible entrants will be void. Entrants may not enter using multiple e-mail addresses or as multiple entrants. Any entrant who attempts to enter with multiple e-mail addresses or under multiple identities, or uses any other device to enter multiple times will be disqualified. All entries become the property of the Company and will not be acknowledged or returned.
(h) In the event a participant in the contest disputes the points that such participants receives for any week of the contest, that participant must notify the Company in writing of such dispute within five (5) days of the Company declaring the results for such week. The failure to notify the Company within such five (5) day period shall constitute the agreement of the participant that the determination of participant’s points by The Company is accurate and participant shall be deemed to have the number of points determined by the Company even if such determination was in error. Notifications to the Company may be done by clicking on the support tab and then clicking on contact us.
(i) The Company reserves the right, in its sole discretion, to cancel or suspend the contest should virus, bugs, unauthorized human intervention, or other causes beyond the control of The Company, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the contest or for any other reason at the sole discretion of The Company.
The Prize (s)
1. Sixteen (16) weekly winners will each receive a $20 gift certificate to The ESPN Zone.
2. Winners will be notified by email on each Tuesday during the Contest Period. Within ten (10) days of notification, winners must claim their prize in person. Before receiving prizes, winners must provide their correct name, address, telephone number, and social security number to the Company at the time of notification. Before receiving prizes, winners must also sign and return a release and affidavit of eligibility, which will be emailed to the winner after claiming the prize on the website and which must be received by the Company with fourteen (14) day notification.
3. If a winner is not eligible to be the winner, or does not timely complete and return the release and affidavit of eligibility, or does not claim the prize within ten (10) days of notification, then the prize may be awarded to the entrant with the next highest score. The Company reserves the right to extend the time period by which the winner must take necessary action to claim the prize.
4. There will be no substitutions or cash alternatives for prizes except at the sole discretion of The Company. The Company has the right to substitute a prize of similar value. No transfer or assignment of prizes is allowed.
5. The winners are responsible for paying all local, county, state and federal taxes on prizes based on the estimated retail value of the prizes as set forth in these rules.
6. Only one weekly prize will be awarded per household.
7. The Company and sponsors shall not be liable if the provider of any part of the prize fails to satisfy its obligations to furnish its portion of the prize.
8. The Company and sponsors are not responsible for any liabilities arising directly or indirectly from the award or use of the prize.
9. In claiming a prize, winner must acknowledge that The Company has the right to publicize winner’s name, character, likeness, photograph, and voice for promotional purposes without financial remuneration.
10. The Company shall not be responsible for the failure of any winner to claim a prize as a result of such winner’s failure to receive an e-mail from The Company regardless of the reason for such failure.
Odds of Winning / Miscellaneous
1. Odds of winning depend on the number of correct entries received.
2. Prize winners will be listed on the contest website. Official rules are available online at www.foxbaltimore.com, or at the station during normal business hours at 2000 W. 41st Street, Baltimore, MD 21211.
3. This contest is subject to all applicable laws and regulations and is void where prohibited. The Company and any local sponsors accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession or use of any prize awarded hereunder.
4. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of The Company or any sponsor, shall be governed by and construed in accordance with laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules or provisions (whether Maryland or any other jurisdiction) that would cause the application of the laws of any other jurisdiction other than Maryland. The invalidity of unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as of the invalid or unenforceable provision was not contained therein. All claims relating to the contest must be brought in the federal or state courts located in Baltimore County, Maryland, which shall have the exclusive jurisdiction and venue over such claims.
5. The Company cannot be held liable for any lost or stolen entries, prizes or contest information.
6. The Company reserves the right to make rules and contest changes and change the aforementioned contest dates at any time and in its sole discretion.
No purchase necessary. One valid entry per contestant.
You must be 18 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law. Winners can be limited to citizens of the United States or Canada.
Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If UPICKEM or its affiliates cannot find an eligible winner for the prize, that prize will not be awarded.
Odds of winning depend on the number of eligible entries received.
UPICKEM and its affiliates reserve the right to substitute any prize with another prize of equal or greater value.
Affiliates reserve the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of UPICKEM and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to UPICKEM and its affiliates the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
UPICKEM and its affiliates reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and its affiliates are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
If a game is canceled, forfeited, or indefinitely suspended for any reason, or if a game results in a tie, that game shall not count for any contestant and scores will be computed as if the game did not exist.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
The point value for each game is clearly marked. The sum of a player's best 17 weeks is the player's total score. The worst 4 weeks are thrown out.
If a player doesn't pick the computer will select the most picked teams for them. However, a player can't win a weekly prize unless they make their own picks and they can't win an overall prize for the season unless they pick at least 11 weeks (just over half) on their own.
Ties are broken as follows:
For an individual week:
Fans pick who they think is going to win each game along with the score for the tie-breaker game. The computer then takes all the fans who are tied for most points for the week and:
1. Subtracts what the fan chose as the score for the winning team from the actual winning team's score and squares this value.
2. Subtracts what the fan chose as the score for the losing team from the actual losing team's score and squares this value.
3. Adds 1 and 2 above together to get the fan's "score approximation".
4. The fan with the lowest "score approximation" wins.
If there is still a tie the computer then chooses a random winner from those who are tied.
For the overall season:
Each week fans pick who they think is going to win each game along with the score of the tie-breaker game. The computer then takes all the fans who are tied for most points for the season and looks at the final week's tie-breaker game and:
1. Subtracts what the fan chose as the score for the winning team from the actual winning team's score and squares this value.
2. Subtracts what the fan chose as the score for the losing team from the actual losing team's score and squares this value.
3. Adds 1 and 2 above together to get the fan's "score approximation".
4. The fan with the lowest "score approximation" wins.
If there is still a tie the computer then looks back at the previous week's tie-breaker "score approximation". If there is still a tie the computer goes back each week until the tie is broken. If there is still a tie after going back through all the weeks the computer chooses a random winner from those who are tied.
Pro Football Regular Season Survivor Game
Beginning with the first week of the season players pick the team they are sure will win that week.
If they pick correctly they'll advance to the next week. However, the only catch is that in future weeks they can't pick the same team again.
If they're wrong you'll still be in the pick'em game, but you're out of this game within the game.
Ties are broken by looking at the final players' overall pick’em scores through the end of the regular season.
If there are still ties then the computer looks at the last week's tiebreaker scores.
If there are still ties the computer picks randomly from those still in the running.
All decisions of the judges are final.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
UPICKEM and its affiliates reserve the right to change the rules at any time.
